Nimiidia.com reserves the right to refuse service and / or access to its servers to anyone.

Nimiidia.com does not allow any of the following content to be stored on its servers:
     Illegal Material - This includes Copyrighted works, Commercial Audio, Video, or Music files, and any material in violation of any Federal, State or Local regulation.

     Warez - Includes pirated software, ROMS, Emulators, Phreaking, Hacking, Password cracking. IP spoofing, etc., and encrypting of any of the above.  Also includes any sites which provide "links to" or "how to" information about such material.

     Unacceptable file types - Nimiidia.com does not allow the upload of .exe or .dll files to its server space by its customers.  Any site found to be hosting such file types will be terminated without refund.

RESOURCE POLICY
     Resources are defined as bandwidth and / or disk space and / or processor utilization.  Nimiidia.com allows the consumption of 500MB of disk space and a monthly bandwidth allowance of 25GB per web hosting account. In the event, where a customer is found to be exceeding these limits or monopolizing processor utilization, Nimiidia.com reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY
     Nimiidia.com may implement the following policy to its sole discretion.  When a website is found to be monopolizing the resources available, hence jeopardizing server performance and resources for other customers, Nimiidia.com reserves the right to suspend that site immediately*.  This policy is implemented to prevent the misuse of our servers.  Customers may be offered an option whereby Nimiidia.com continues hosting the website for an additional fee.

*Please Note: Domain2host.com Reserves the right to suspend services to any account that it find affects overall server performance for other customers hosted on the same server (this does not necessarily mean issues related only to bandwidth or diskspace consumption).  This suspension is effective immediately on action by the Abuse Team and customers are reminded to read the Backups policy below regarding this.

BACKUPS
     Domain2host.com do not keep backups of our customer's files once they are uploaded to our servers.  By signing up with Domain2host.com you accept the responsibility of making backup copies of your files.

EMAIL STORAGE
     Domain2host.com cannot allow the storage of more than 50MB of e-mails on it's servers and reserves the right to remove e-mail storage files during server maintenance that exceed the 50MB limit per POP account.

PRICE FREEZE GUARANTEE
    Domain2host.com guarantees for as long as you are a continuous client, in good financial standing, and you keep renewing your contract for web hosting service, we guarantee that you will be locked into paying today's web hosting prices forever.

FREE DOMAIN NAME
    When a user signs up for the Domain2host.com Windows 2000 or Windows.NET Plan, Domain2host.com will pay for the cost of their new Domain name registration. Domain2host.com will keep paying it every year, for as long as they are a continuous client, in good financial standing, and keep renewing their contract for web hosting service. (please see exclusion below) This only applies to domains with extensions .com, .biz, .info, .net, .org and .co.uk  If the client decides to transfer an already registered domain name to Nimiidia.com's servers for use with the Nimiidia.com Windows 2000 or Windows.NET Plan, then they are responsible for all Registrar fees for that domain.

Exclusion
      Domain2host.com registers all new domain names through wholesale domain name registrars. These domains then reside in a single account at the registrar and can therefore be renewed by Domain2host.com as part of the service supplied.  If a domain name is transferred from this account (either to another registrar or to another account at the wholesaler concerned) the domain name concerned is no longer eligible for free renewal by Domain2host.com and all renewal fees become the responsibility of the customer at time of transfer.

Please Note
     To register your domain quickly and keep prices to a minimum we bulk register domains. This means that you will see Nimiidia.com details as the current domain name owner.

     We will transfer ownership of the domain name to you when a request to do this is submitted on our online Helpdesk.** This enables some clients to remain anonymous owners of their domain name.

(** requests for transfer of domain ownership from ourselves to you the customer will only be accepted a minimum of 6 months after full payment has been made for the account concerned (initial order or renewal payment whichever has been most recently charged).      

     Please submit the full new ownership details you would like listed and submit your ticket to the DNS Changes category.

PAYMENT POLICIES
     All accounts are set up on a prepay basis. Domain2host.com reserves the right to change prices of accounts or services at any time except in price freeze circumstances. Payment is due each anniversary year following the date the account was established. Customers will automatically be charged at any time in the 35 days leading to the anniversary date in order to ensure the transition from one hosting year to the next and to avoid wherever possible any interruption to service unless closure notification has already been given.

     In situations where the card number on file is declined Nimiidia.com will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, Nimiidia.com reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

     No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

PAYMENT OPTIONS
     In order to streamline our accounting procedures and keep costs down Domain2host.com runs a limited number of payment options.

Credit / Debit Cards
     Domain2host.com accepts VISA, MASTERCARD, and AMEX. Please allow for slight fluctuations in foreign currency exchanges.

Domain2host.com reserves the right to stipulate method of payment in rare circumstances where other methods of payment may be considered unsuitable.

CANCELLATION AND REFUNDS
     Whilst the vast majority of our customers will be perfectly satisfied with our service and remain with us for many years after ordering, we do recognize that on rare occasions, the agreement between the customer and ourselves will need to cancelled. We would encourage customers to contact our customer services department in the first instance to ascertain if we can resolve any issue causing a customer to consider canceling, but if the eventuality does arise, our cancellations policy is as follows:

     Customers may cancel their account at any time. Any customer canceling their service will be entitled to request a pro-rata refund based on the months of unused hosting remaining.

     Likewise, Domain2host.com reserves the right to cancel the service at any time. In this event customers again will be entitled to a pro-rata refund based upon the remaining months of membership. If a customer contravenes Nimiidia.com's terms of service a refund will not be issued in the event of a cancellation.

     In the event of any refund, a US$20 administration charge is retained by Nimiidia.com.
In addition, US$16 is also retained by Domain2host.com to cover annual .com, .net, .org Domain name expenses or US$32 to cover .biz, .info, .co.uk or other biannual domain expenses if the domain was registered by Nimiidia.com

     For example, a cancellation after 6 months service would generate a refund of the remaining 6 months service minus a US$20 Administration fee and US$16 or US$32 fee dependant on domain type if the domain was registered as part of the order.

     All refunds will be paid in the same manner as the original order was made.

Cancellation of Upgrades
      In the event of any refund, Domain2host.com reserves the right to levy an administration charge of US$20 to be deducted from the fee.  Please note that no refund whatsoever will be made for domain name registration orders.  This is because of the domain registrar's policy on registrations. They are charged a non-refundable fee by the registry to perform the registration and this procedure cannot be cancelled.  By registering a Domain name you are renting a piece of the Internet, through us as your broker, with the collective that monitors the Internet.  Once a domain name has been added to the Internet it cannot be removed until it expires.

INDEMNIFICATION
     Customer agrees that it shall defend, indemnify, save and hold Nimiidia.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Domain2host.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.  Customer agrees to defend, indemnify and hold harmless Domain2host.com against liabilities arising out of; (1) Any injury to person or property caused by any products sold or otherwise distributed in connection with Domain2host.com' server; (2) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) Copyright infringement and (4) Any defective products sold to customer from Nimiidia.com' server.

DISCLAIMER
     Domain2host will not be responsible for any damages your business may suffer.  Domain2host.com makes no warranties of any kind, expressed or implied for services we provide.  Domain2host.com disclaims any warranty or merchantability or fitness for a particular purpose.  The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by Domain2host.com and its employees.  Domain2host.com reserves the right to revise its policies at any time.

.US Domain Name Eligibility Requirements
      Any U.S. citizen or resident, as well as any business or organization, including federal, state, and local government with a bona fide presence in the United States can register a .US domain name.

One of the following eligibility requirements must be met
      A natural person (i) who is a citizen or permanent resident of the United States of America or any of its possessions or territories or (ii) whose primary place of domicile is in the United States of America or any of its possessions, or

     Any entity or organization that is incorporated within one of the fifty (50) U.S. states, the District of Columbia, or any of the United States possessions or territories or (ii) organized or otherwise constituted under the laws of a state of the United States of America, the District of Columbia, or any of its possessions or territories, or

     An entity or organization (including federal, state, or local government of the United States, or a political subdivision thereof) that has a bona fide presence in the United States.
